These are the Promotion Participant Terms and Conditions for the promotional Promotion of chance for the promotion of the EMS Leadership Academy’s Back to School Celebration giveaway event (hereafter “Promotion”) offered by EMS Leadership LLC (Known as the EMS Leadership Academy), located at 40 Aviation Rd, Suite 210, Albany, NY 12110, USA  and registered with the trade register by IRS EIN/TIN 86-2016246 (hereafter “Company”). 

GENERAL CLAUSES

1. These Promotion Participant Terms and Conditions apply to the Promotion offered by the Company and do not apply to any other services offered by and/or agreements with the Company.

2. Participation in the Promotion implies the participant agrees with these Promotion Participant Terms and Conditions, as well as with all decisions the Company takes to ensure the Promotion runs smoothly.

3. If any provision in these Promotion Participant Terms and Conditions is void or voided, the remaining provisions will remain in full force. The Company will replace the void provision with new a provision, whereby the purpose and scope of the original provision will be taken into account as much as legally possible. 

4. The Company may at any time, in its sole discretion and without giving prior notice, change these Promotion Participant Terms and Conditions, unless these changes are to the disadvantage of the participant.

5. By entering this Sweepstakes, you promise to abide by the Official Rules and decisions of Sponsor, which will be final and binding in all respects. Sponsor reserves the right, at its sole discretion, to refuse, disqualify or withdraw any entry at any time. Sponsor will not be responsible for any injury, damage or loss of any kind arising out of your participation in the Sweepstakes. YOU AGREE TO RELEASE, DISCHARGE, AND HOLD HARMLESS  SPONSOR, ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, OFFICERS, DIRECTORS,  AGENTS AND ASSIGNS FROM AND AGAINST ANY OR ALL CLAIMS, LOSSES, INJURIES,  OR DAMAGES RESULTING FROM PARTICIPATION IN THE SWEEPSTAKES. Except where  prohibited by law, by accepting prize, winner grants Sponsor a perpetual, worldwide, royalty-free  license to use winner’s name, photograph, voice, and/or likeness without further authorization,  compensation, or remuneration of any kind for advertising, promotion and other publicity  purposes in any and all media now or hereafter known throughout the world.

PROMOTION PARTICIPATION

6. The Promotion runs from September 17, 2023 1800 ET to September 29, 2023 drawing from 1130-1300 ET.

7. Participation in the Promotion is only open to persons living in one that allows for this promotion.

8. Participants can participate in the Promotion by registering for the Promotion on the website www.emsleadershipacademy.com/celebrate and agreeing to receive the Company’s newsletter communications. 

9. Participants can increase their chances of winning additional incentives by inviting friends to join the Promotion and/or look at the Company’s website, by entering e-mail addresses from friends. Every invite will increase the participant's chance of winning the Promotion. 

10. Participation in the Promotion is excluded for employees of the Company as well as anyone who is (in)directly involved in any way in the development and the implementation of the Promotion.

11. Participants under the age of 18 are excluded from participation in the Promotion.

HOW TO ENTER

12. How to Enter. During the Entry Period, visit the Sweepstakes registration page located on Sponsor’s website at www.emsleadershipacademy.com/celebrate and follow the instructions to electronically complete and submit the Sweepstakes entry form. You will be asked to provide basic contact information. (NOTE: You must complete all required fields of the entry form with information that is valid on the date of the drawing to be eligible). If entering the Sweepstakes via Facebook, you must be the owner of the email account associated with the Facebook account from which your entry is made. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand you are providing your information to Sponsor and/or Administrator and not to Facebook. All entries become the property of Sponsor and none will be acknowledged or returned.

PRIZES

13. The participant in the Promotion has a chance to win access to our Keeping the Best™ Leadership online program plus a book pack  with a total worth of $700 USD.

14. Keeping the Best™ was designed for EMS Leaders struggling to keep their top talent and stop the revolving door of recruitment and retention, where people leave as quickly as they come in the door. Access to this online program will be granted to one grand prize winner, along with a physical book bundle selected by the Company.

15. Images and descriptions are for illustrative purposes. The actual versions of the prizes may differ.

16. Winners will be selected in an impartial and random manner by a computer system and will be notified by e-mail within one (1) week. There will be no other correspondence about the result. 

17. Exchanging or returning prizes is not possible. The prize is personal and not transferable or exchangeable for money.

COSTS

18. To participate in the Promotion, no additional communication costs will be charged. Furthermore, no payment or purchase is required for participation in the Promotion.

RESPONSIBILITIES

19. The winner agrees to behave in accordance with any applicable rules of conduct of the Company and/or other third parties concerned at any locations of the Company and/or third parties.

RIGHTS OF THE COMPANY

20. The Company reserves the right, without obligation of giving any reason and at its own discretion, to exclude participants from participation of the Promotion if the participant violates these Promotion Participant Terms and Conditions or any other legally applicable provision.

21. The Company also reserves the right to prematurely terminate, interrupt or change the Promotion at its own discretion and without prior notice and/or modify the prizes that can be obtained if it cannot be reasonably expected from the Company to adhere to the original terms, prizes and/or Promotion. 

22. In the event of knowledge or suspicion of violations, fraud or abuse, the Company has the right to suspend participation and/or to declare participation invalid, without obligation of giving any reason.

23. WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

PRIVACY

24. Participants guarantee that that personal data provided during the participation procedure is correct, truthful, up-to-date and complete. The foregoing is required to be able to send any prize winners the prize, as well as sending the newsletter. The Company can provide this information to third parties if this is necessary for the provision or the delivery of the prize.

25. Any complaints or questions about the Promotion, prizes or these Promotion Participant Terms and Conditions may be sent directly to the Company’s e-mail support@emsleadershipacademy.com.

26. The Company strives to respond to questions and complaints within 3 working days after receiving the complaint.
